1. Definitions
SOCIETE : The company SOUND SKULPTOR (SSKSAS), with a capital of 20 000€, registered at the "Chambre de commerce" of Auch (France), under the number 433 956 265.
Address : 65 IMPASSE DE LA RETHOURIE, 32000, AUCH, FRANCE.
BUYER : Any person, company or legal entity, who places an order that is accepted by SOCIETE.
WEBSITE : The website of SOCIETE at the URL : "www.soundskulptor.com".
2. General
All orders for products and services on the WEBSITE are accepted by SOCIETE subject to these terms and conditions of sale. No other terms will apply to the supply of products unless agreed in writing by an authorised signatory of SOCIETE.
SOCIETE reserves the right to modify these conditions at any time. In such case the applicable conditions will be the ones that are valid at the date of order by the BUYER.
SOCIETE reserves the right to decline to trade with any company or person.
3. Products
The available products are those described on the WEBSITE.
The products are available as long as stock lasts.
All descriptions of the products and services contained on the WEBSITE are approximate only and shall not form any part of the contract between SOCIETE and the BUYER. SOCIETE may correct any errors in its website without liability to the BUYER.
SOCIETE reserves the right, without prior notice, to discontinue any product or to make design changes as part of its continuous programme of product improvement.
4. Price
The prices are given exclusive and inclusive of French VAT (20%), in Euro.
The price of products and services are as set out in the WEBSITE at the date of order.
SOCIETE reserves the right to modify the prices at any time, without notice.
The item price do not include the shipping costs. They are added during checkout.
Import duties and taxes are not included in the item price or shipping cost. These charges are the buyer's responsibility.
If the BUYER is a registered EU company, with a valid VAT number, he can request a VAT free invoice. This can be done by creating an account.
5. Orders
The BUYER willing to purchase a product must :
- On the website, select the products you want to purchase and click on the "Add to cart" button. When your order is completed click on the "Checkout" button.
- Fill the personal information page. You can add comments to your order in the "Additional information" field. When ready, click on the "Checkout" button.
- Select a payment option. Click on the "Checkout" button.
- Select a shipping option. Click on the "Checkout" button.
- Check total. If everything is correct, click on the "Checkout" button.
6. Right of refund
The BUYER, natural person only, has the right to return goods, at his own cost and risk within 14 days after delivery, for exchange or refund. The goods must be returned in their original state and packing. Any shipping costs and bank transaction fees will be deducted from the refund amount.
No return will be accepted without a previous agreement from SOCIETE by email.
7. Payment
The price is to be paid at ordering.
The payment can be done by credit card or bank wire transfer.
The credit card payments are done through Paypal.
The BUYER account will be pulled immediately after payment. The products will be shipped as soon as the account of SOCIETE has been credited with the corresponding amount. It is necessary to allow for about 3 to 10 working days, depending on the payment mode and country.
A PDF invoice will be emailed when the products are shipped.
8. Delivery
The carrier delivers to the address indicated by the BUYER at the time of ordering.
An insurance covering the price of goods is always included.
A signature is required for delivery.
The BUYER must inspect the content of the package in presence of the deliveryman. An accepted parcel is presumed to be in good state. In case of damaged products, the BUYER must refuse the delivery. If the package shows signs of transportation damages but the delivery is accepted, the BUYER must notify written reserves to the deliveryman. If product damages are detected later, a claim by registered letter must be sent to the carrier company within 3 days from delivery. The BUYER must also inform SOCIETE within the same delay.
Any delivery of products not in accordance with the order can be returned to SOCIETE. In this case SOCIETE will replace the products or refund the purchase price. No return will be accepted without an previous agreement of SOCIETE by mean of email.
Delays for delivery quoted on the WEBSITE or in emails from SOCIETE are approximate only and SOCIETE shall not be liable for the consequences of any delay in delivery.
In all cases, all deliveries will be made within a maximum of thirty (30) days. If it is not possible to guarantee this, the BUYER will be informed at the earliest possible time and has the option to cancel the order. An exchange or refund may be possible.
9. Risk and Ownership
Risk of loss of or damage to the products shall pass to the BUYER on delivery. Goods remain the property of SOCIETE until full payment has been received.
10. Repairs
In case the BUYER of a kit would be unable to make it work, we propose a repair service. The diagnostic is free. The price of this service is based on a hourly fee to which must be added the price of replaced components if any. The shipping costs to and from SOCIETE are to be paid by the BUYER.
The repair service is subject to the availability of parts and is only available if the product has not suffered excessive physical or electrical damage and is free from modifications .
11. Warranty
For all the products delivered by SOCIETE, SOCIETE warrants that if any product is defective, it will replace or repair the product or refund the purchase price. This warranty is only applicable to the products that are built and tested by SOCIETE, as well as to electronic components, at the condition that they have been used as described in the assembly and testing guides on the WEBSITE. These warranties shall not apply to any defect which arises from improper use or failure to follow the product instructions. In no case this warranty can apply to a kit product that has been built by the BUYER. This warranty is subject to a claim being made in writing to SOCIETE within 12 months of the original date of delivery. The shipping costs to and from SOCIETE are to be paid by the BUYER.
12. Intellectual property
SOCIETE owns the intellectual property rights in the website content, and whole or partial reproduction without SOCIETE's prior written consent is prohibited.
13. Privacy Policy
SOCIETE do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.
